Q&A
Q&A: Workers’ Comp Law for Temporary Staffing
Q1: What is workers’ compensation and why is it significant for temporary staffing agencies?
A1: Workers’ compensation (workers’ comp) is a form of insurance providing wage replacement and medical benefits to employees injured in the course of employment. For temporary staffing agencies, workers’ comp is crucial because it ensures financial protection for both the agency and their temporary employees in case of workplace injuries, mitigating liability risks and ensuring compliance with state laws.
Q2: Who is responsible for providing workers’ comp coverage in temporary staffing arrangements?
A2: Generally, the temporary staffing agency is responsible for providing workers’ comp coverage for their temporary employees. As the agency is the official employer, it must carry workers’ comp insurance, irrespective of where the employee is assigned. However,it’s essential for staffing agencies and host employers to clearly define responsibilities in their contractual agreements.
Q3: How does workers’ comp coverage work when a temporary employee is injured on a host employer’s site?
A3: When a temporary employee is injured at a host employer’s worksite, the staffing agency’s workers’ comp insurance typically covers the injury.
